Terms of Use

These Terms of Use ("Terms") govern your access to and use of the AI Aware Certified™ website, courses, digital content, certification programs, and related services (the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree, do not use the Services.

1. Who We Are

AI Aware Certified™ is owned and operated by AI Aware LLC, a Wyoming-registered limited liability company in the United States, doing business as AI Aware Certified™. All references to "we," "us," or "our" refer to AI Aware LLC.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into a binding agreement
  • Use the Services in compliance with all applicable laws

If you are accessing the Services on behalf of an organization, you represent that you have authority to bind that organization.

If you have been admitted to a beta tester cohort or have early access to pre-release content, that access is governed by a separate Non-Disclosure Agreement ("NDA"), which applies in addition to these Terms.

3. License to Use the Services

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or organizational training purposes, for the access duration disclosed at the time of purchase (typically 12 months for individual courses, 24 months for the bundle).

You may not:

  • Copy, distribute, or share course materials
  • Resell or sublicense access
  • Use content to build competitive training programs
  • Remove branding, copyright notices, or proprietary markings
  • Use AI Aware Certified™ content to train, fine-tune, or evaluate AI models or datasets
  • Bypass technical access controls (e.g., LearnWorlds DRM)

All rights not expressly granted are reserved.

4. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity under your account
  • Ensuring your information is accurate and up to date

One account is intended for one individual learner. We may suspend or terminate accounts for misuse, fraud, or policy violations. Upon termination, your license to access course content ends.

5. Intellectual Property

All course content, videos, narrations, slides, lab artifacts, text, graphics, logos, badges, certification materials, and digital assets are the property of AI Aware LLC and protected by U.S. and international copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.

Third-party frameworks referenced in courses (e.g., ISO/IEC 42001, NIST AI RMF, EU AI Act, OWASP guidance) remain the property of their respective owners.

6. Certification Requirements

Certification is granted only when:

  • All required modules are completed
  • All assessments are passed
  • All identity or verification requirements (if applicable) are met

Capstone exams are taken on an honor system. By taking an exam, you confirm you are the registered learner and are completing it without unauthorized assistance. We reserve the right to revoke certification in cases of fraud, cheating, or misuse.

7. No Production Data on Our Platforms

You agree NOT to upload, paste, store, or transmit any production data, real credentials, real PII, real customer data, or confidential information belonging to your employer or any third party on the AI Aware Certified™ platform, in lab submissions, or in any communication channel we operate.

This includes (without limitation): real service account credentials, real API keys, real user PII, real customer data, real PHI/PCI/financial data, production IAM policies in active use, real cloud account identifiers, real network diagrams, or proprietary information of your employer or any third party.

Course labs that include "bring your own data" patterns are designed to be performed on your own work-sanctioned device, in your own work-controlled environment. Lab artifacts and outputs remain on your device or in your own organization's systems. The platform provides synthetic and sample data for exercises — you are responsible for adapting those patterns to your real environment privately, never on AI Aware Certified™ infrastructure.

If you upload production data in violation of this Section, you bear sole responsibility for any breach of your employer's data handling policies or applicable data protection law (GDPR, CCPA/CPRA, HIPAA, GLBA, etc.). We may, in our discretion, immediately delete the uploaded data, suspend or terminate your account, and notify your organization without further notice. If you accidentally upload production data, contact aiaware@aiawarecertified.com immediately.

8. Refunds

Refunds are governed by our Refund Policy. By purchasing a course, you acknowledge and agree to the terms of that policy.

9. Prohibited Conduct

You agree not to:

  • Share login credentials or course access with others
  • Attempt to bypass access controls
  • Copy or scrape course content
  • Use the Services for unlawful purposes
  • Harass or harm other users or instructors
  • Upload malicious code or attempt to disrupt the platform

If you have a coordinated security disclosure to make, contact aiaware@aiawarecertified.com first — that is not unauthorized probing.

Violation may result in account termination without refund.

10. Disclaimers

The Services are provided "as is" without warranties of any kind. AI Aware LLC does not guarantee:

  • Employment outcomes
  • Compliance outcomes
  • Legal or regulatory approval
  • Accuracy of third-party information

Our content is for educational purposes only and does not constitute legal, compliance, or security advice. See our full Disclaimer.

EU and UK consumers: mandatory consumer protections under your local law apply in addition to these Terms and may grant you rights that override contrary provisions herein, including the right of withdrawal under the EU Consumer Rights Directive and EU Digital Content Directive (see our Refund Policy).

11. Limitation of Liability

To the fullest extent permitted by law:

  • AI Aware LLC is not liable for indirect, incidental, or consequential damages
  • Total liability for any claim shall not exceed the amount you paid for the course in the twelve (12) months preceding the event giving rise to the claim

Some jurisdictions do not allow certain limitations; in those cases, the limitation applies to the maximum extent permitted.

12. Privacy

Your use of the Services is also governed by our Privacy Policy.

13. Other Terms

Modifications: We may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms. The version in effect at the time of your purchase governs that purchase.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy, Refund Policy, Disclaimer, and any beta-cohort NDA, constitute the entire agreement between you and AI Aware Certified™ regarding the Services.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles. Any disputes shall be resolved exclusively in Wyoming state or federal courts, except where preempted by mandatory consumer protection law of the consumer's place of residence.
